Development of a Leasing Industry in Lesotho
Introduction
The Government is pursuing the establishment and development
of a leasing industry
with the support of the PSC project by (i) the drafting and
promulgation of a Leasing
Act consistent with the corresponding Act in South Africa,
which will indicate the
rights, duties and obligations of participants including
those related to the adjudication
of cases; and (ii) designing as appropriate a tax regime
applicable to the leasing
industry and diversify the sources of leasing finance by
tapping insurance firms and
pension funds, with the objective to attract investors with
experience in leasing to set up
operations in Lesotho, (iii) and designing and implementing
a Technical Assistance and
training program to SME’s, in coordination with the
commercial banks that already
provide some training to potential clients.
The Government of Lesotho would therefore like to engage a
Consultant to carry out
the need assessment and the design of the program to be
implement by the project.
Key Objectives of the Assignment
The key overall objective of this assignment is to design a
program needed for
establishing a well functioning leasing industry in Lesotho.
This program will be
supported under the World Bank Competitiveness and Economic
Diversification
Project.
Tasks
The Consultant will undertake the following tasks:

Develop an
effective leasing act in Lesotho, conducive to the
development of the industry and an action plan on
implementing the act identifying the key stakeholders,
their respective roles and responsibilities and the
resources required including preliminary cost estimates;

Develop a
dedicated training that would consist inter alia of a
combination of workplace and centralized skills
programs, and the definition of the required curriculum
etc.

Design
appropriate tax regime applicable to the leasing
industry and other actions and reform needed to attract
leasing institutions in Lesotho.

Design of
a lease registry or similar arrangements to support the
leasing industry based on models from the Region
especially RSA
-
Develop an
overall action plan to implement the leasing industry in
Lesotho including formulation and adoption of the legal
framework, institutional arrangements, investment
promotion and facilitation, training and awareness
campaigns and regulatory arrangements.
The program
will draw upon the lessons learned from South Africa.
Requirements
The consultant should have the following expertise:

Expertise
in leasing development, familiar with SME training and
human resource development;

Experience
in taxation of financial institutions;

Expertise
in financial sector development;
-
International experience in designing/reviewing a
legislative framework (including tax regimes) for
establishing a well functioning leasing industry.

International experience in designing a capacity
building/training program supporting leasing industry
Duration of
the assignment
Approximately 6 weeks.
